Abstract

Islamic Civil Law is part of Islamic law that has been formally enacted or has become positive law in the Indonesian legal system. Its content is only part of the scope of mu'amalah, and this part of Islamic law has become positive law based on or because it is designated by legislation, including marriage law, inheritance law, wills, grants, zakat, and waqf. This study uses a literature review method with a qualitative approach, utilizing various sources such as books, journal articles, magazines, online media, and other publications relevant to Islamic civil law in Indonesia. The results of the study show that the application of Islamic civil law in Indonesia has been ongoing for several decades, including during the period of Islamic kingdoms/sultanates in the archipelago, the Dutch colonial period, the independence period, the Old Order period, the New Order period, and the Reformation period. All of these periods have seen development and improvement.
